Legal · EU Data Act

Data Act information.

Disclosures under Articles 28 and 29 of Regulation (EU) 2023/2854, as referenced in Sections 12.5 and 12.7 of our Terms of Service. This is a summary; the canonical version governs.

Jurisdictions of our infrastructure

The services run exclusively on ICT infrastructure in the European Union, subject to French and Polish jurisdiction within the framework of Union law.

  • Albi, France
  • Champs-sur-Marne, France
  • Cracow, Poland

The operator, Aurora Infrastructure EU sp. z o.o., is incorporated in Poland (KRS 0001166368) and has no non-EU parent company, so it is not subject to a third country’s jurisdiction through its corporate structure.

Measures against conflicting third-country access

  • Every third-country request for non-personal data held in the EU is assessed against Article 32 of the Data Act, and acted on only where an international agreement or the strict conditions of Article 32(3) allow it.
  • Where a response is permissible, only the minimum data is provided.
  • The affected customer is told before we comply, unless notice is prohibited for law-enforcement purposes.
  • Demands that conflict with Union or Polish law are refused and, where appropriate, challenged in court.

Switching charges

Switching away from Aurora costs nothing: there are no switching charges and no early-termination penalties. Our help with the switch is free, and so is data egress for the switch and during the retrieval period. Until your contract ends, the services you use are billed at the standard rates in the price list.

The procedure, timelines, and exportable data for each service are set out in the Switching & Portability Annex.
